Decision:
Following race 6 an information was lodged pursuant to Rule 871(1)(d) when it was alleged that Mr J Collett committed a breach of the rule in that passing the 200 metres he allowed his mount MILL DUCKIE to shift out contributing to CHARLOTTE RUSSE ( A Calder ) having to be checked when tightened for room between his mount and L’AVANTI (L Innes ) which shifted in.

--Mr Collett, who was represented by his employer Mr R Collett, admitted the charge.
--As Mr Collett has admitted the charge the committee has to adjudicate on penalty only. It was accepted by all parties that the videos had been extensively observed during the earlier protest hearing involved in this same movement and therefore a reviewing of them was not required.
--Mr Sanders pointed out that Mr Collett was about to begin a suspension received at an earlier days racing and there was some concern that this was his 5th offence committed in his short riding career which must be of some concern. He asked for a suspension at the lower end of the scale.
--Mr Collett had nothing to add.
--DECISION:
The committee considered all matters including Mr Collett’s record which has to be of some concern that a rider of Mr Collett’s ability continues to put other riders safety at risk. The committee also took into account that the offence was not of a serious nature.
The committee does have confidence that Mr R Collett, his apprentice’s employer, will take measures to ensure that there is a marked improvement in Mr J Collett’s riding performance.
--After giving all matters due consideration Mr Collett is suspended from race riding from after the finish of racing on 18 April till the finish of racing on 25 April 2009. (4 days)
