As Mr Cooksley admitted the breach we found the charge proved.
Penalty:
Mr Cooksley is suspended from the close of racing on Saturday March 19th up to and including racing on Friday April 1st.

Facts:
Following the running of Race 5, New Zealand Herald 1400, , an Information was lodged by Mr Oatham under Rule 638(1) (d) in that G Cooksley allowed (SEVENTH UP) to shift out near the 150m when not clear of CANCELLARA, A Jones, which had to be checked.
Mr Williamson outlined the incident on the video identifying Mr Cooksley racing in a position three-off the fence. At this stage of the race Mr Cooksley was held up for a run. Two horse-widths further out and in front of him was CANCELLARA ridden by Ms Jones. Mr Cooksley angled outwards from behind the horse ENOUGH and took the line of Ms Jones when only 1 length clear of that runner.
Mr Cooksley mostly agreed with Mr Williamson’s assessment of the incident but said Ms Jones had not been checked, she had just had to take hold for a few strides.
Submissions for Penalty:
Mr Oatham advised the hearing that Mr Cooksley had only one suspension for careless riding in the last 12 months which was a three day suspension incurred in May 2015. In regard to today’s breach Mr Oatham said the breach was at the low end of the scale and submitted that a term of suspension in line with that assessment be imposed.
Reasons for Penalty:
The Judicial Committee Penalty Guide provides that the starting point for penalties imposed for careless riding is a five day suspension. Mitigating factors for Mr Cooksley were his admission of the breach, his excellent record and the low level of carelessness. Mr Cooksley simply made an error of judgement when angling out seeking a clear run. There were no aggravating factors. We have allowed a discount of one day arriving at an appropriate penalty of four days suspension.
Mr Cooksley advised of riding commitments through until next Saturday and said he was predominantly a Northern rider.
