As Mr Rennie admitted the breach we find the charged proved.

Penalty:

Accordingly, we impose a $150 fine on Ms Latta.

Charge:

Following race 3 an information was filed pursuant to rule 649(4)(b). The informant, Mr Williamson, alleged that gear (towel) was added after the rider had weighed out.

Facts:

Mr Williamson advised the committee that Mr Innes weighed in 0.9kg overweight. He said when Mr Rennie was interviewed by the Stewards he admitted to adding a towel.

Mr Rennie said he was at a loss as to explain why he added a towel. He said it was a completely innocent and genuine mistake. He further stated that he is used to saddling up horses at trials and jumpouts where a towel is part of their gear.

Submissions for Penalty:

Mr Williamson submitted Ms Latta had a clear record under this rule and Mr Rennie was very co operative with Stewards. He said the only other breach of this rule in 2010 resulted in a Trainer being fined $150. He submitted the same penalty for this offence.

Mr Rennie made no submissions on penalty.

Reasons for Penalty:

The committee carefully considered the evidence and submissions presented. The mitigating factors are Ms Latta's clear record and the admission of the breach. The aggravating fact was clearly a towel was added after the rider had weighed out. Mr Rennie showed genuine remorse for his actions. In the interest of consistency we determine a $150 fine to be an appropriate penalty.
