Pursuant to rule 1106(2) the Committee grants Mr Yanagida a deferment until after racing on 15th December 2019.
Accordingly Mr Yanagida license is suspended from after racing on 15th December 2019 to the conclusion of racing on the 20th December 2019. (4 National Days).
Facts:
This charge arises from the running of race 3, The Pond Premium Recruitment 1600. Senior Stipendiary Steward Mr M Williamson filed an information pursuant to Rule 638(1) (d). He alleged Class B Rider Mr T Yanagida (SARDONIA) angled his mount outwards when not sufficiently clear of READY TO ROAR which was checked near the 150 metres.
Mr Yanagida acknowledged that he understood the nature of the charge and the Rule. He also confirmed that he did admit the breach.
Rule 638(1) (d) provides that:
A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham demonstrated the incident using the available video footage. He identified that Mr Yanagida angled his mount out quite abruptly when only a bare length clear of READY TO ROAR. As a result Ms Johnson took a hold of her mount as she anticipated the shift by Mr Yanagida.
Mr Yanagida said that before he shifted ground, he checked that he was clear but accepted that he shifted out “too much” .
Mr Harris said that Mr Yanagida misjudged the manoeuvre and pointed out that Mr Yanagida took one hand off the rein. He added that FOODIE KING shifted out slightly which had a minor contribution to the incident.
Submissions for Penalty:
Mr Williamson said that Mr Yanagida had a clear record under this rule in the last 12 months and the level of carelessness was in the low range.
Mr Yanagida advised that any proposed suspension could start after racing on Sunday the 15th of December.
Reasons for Penalty:
The Penalty Guide for Judicial Committees recommends that the starting point for low range breach is 6 riding days.
On reviewing the video film the Committee deemed the level of carelessness was in the low range and adopted a 6 day suspension as a starting point.
The Committee afforded Mr Yanagida a 1 day penalty reduction for his admission of the breach and a further 1 day reduction for his excellent record over the previous 12 months. This resulted in a 4 day suspension being imposed.
