As Miss Wenn admitted the breach we find the charge proved.

Penalty:

We grant Miss T Wenn’s request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Miss T Wenn which will commence after racing on 16 April and conclude after racing on 25 April 2014 (5 North Island days).

Facts:

Following the running of race 9, Westbury Club Mile, an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr Oatham, alleged that shortly after the start Miss T Wenn permitted her mount RUSSIANOV to shift in, crowding URBAN ANGEL (L Innes), LADY EIKO (V Colgan) and ENDORSEMENT (K Leung) with LADY EIKO and ENDORSEMENT being checked.

Miss Wenn acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Mr S Wenn assisted Miss Wenn at the hearing.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson identified on the head on film the barrier position of the horses recorded in the Information, RUSSIANOV (10) URBAN ANGEL (9) LADY EIKO (8) and ENDORSEMENT (7). He said that initially URBAN ANGEL lay in leaving the barriers making contact with LADY EIKO. He said shortly after this Miss Wenn allowed RUSSIANOV to shift in several horse widths which resulted in crowding to 3 horses on her inside. He said Mr Innes was unable to relieve the inward pressure because RUSSIANOV continued to shift in. Mr Williamson added that LADY EIKO and ENDORSEMENT lost ground as a result of the interference.

Miss Wenn told the Committee that when URBAN ANGEL lay in leaving the barriers her mount followed the inward movement. She believed Mr Innes received pressure from the 2 horses to his inside which contributed to the incident.

Mr Wenn said that URBAN ANGEL had shifted in initially but conceded Miss Wenn was a split second too late in correcting RUSSIANOV’S inward movement.

Submissions for Penalty:

Mr Oatham produced Miss Wenn’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being on 21 December 2013 which attracted a 4 day suspension. He said Miss Wenn had been riding for approximately 1 year and had 99 raceday rides. He assessed Miss Wenn as a relatively inexperienced apprentice rider. He described the level of carelessness as low to mid - range and noted the consequences of Miss Wenn’s inward shift resulted in 3 horses being checked. Mr Oatham advised the Committee that today’s incident occurred on a premier day and the stake of $25,000 was notable for a Rating 75 race. Mr Oatham submitted an appropriate term of suspension would be 5 to 6 days.

Miss Wenn advised that she had upcoming commitments at Rotorua on 16 April, and sought a deferment to any proposed suspension.

Mr Wenn had nothing further to add.

Miss Wenn confirmed that she rode only in the North Island.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Wenn’s admission of the breach and URBAN ANGEL lay in leaving the barriers making contact with LADY EIKO, which in our opinion contributed to the incident. The aggravating factors are Miss Wenn’s inward shift, when not the required distance clear, resulted in 3 horses being checked. We note that ENDORSEMENT and LADY EIKO lost several lengths as a result of the interference.

The Committee considers Miss Wenn’s record under this Rule as average and we assess the level of carelessness as low but the impact of the check as mid- range.

After taking into account all the above factors we consider an appropriate penalty is a 5 day suspension.
