Decision: Following Race 1 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Mr M Coleman,  rider of Harris Tweed, permitted his mount to shift inwards near the 900 metres when not sufficiently clear of Infinite Way (J McDonald) who was checked.

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Mr M Coleman,  rider of Harris Tweed, permitted his mount to shift inwards near the 900 metres when not sufficiently clear of Infinite Way (J McDonald) who was checked.  Mr Coleman admitted the breach.

Mr Williamson demonstrated the video films which showed Mr Coleman, riding Harris Tweed and racing 3 wide, move up from the rear and in doing so move in and crowd Mr J McDonald on Infinite Way.  Mr Coleman was only ¾ clear of Infinite Way when moving in and the resultant check to Mr McDonald caused him to check and clip heels.

Mr Coleman said he misjudged the distance between his mount and Mr McDonald’s when moving in.

PENALTY SUBMISSIONS

Mr Coleman when asked for his commitments said he did not intend to ride at Wairoa.

--

Mr Oatham produced Mr Coleman’s record showing 3 charges in the last 12 months and believed this was in the mid range of carelessness thus warranting a suspension.

PENALTY

--

The Committee considered all evidence and before imposing a penalty took into account the following :

--

-  Mr Coleman’s guilty plea

--

-  His record

--

-  His level of carelessness and the resultant check to Mr McDonald

--

 

--

Normally the Committee believes this offence would warrant a 5 day suspension but because of Mr Coleman’s guilty plea this is reduced to 4 days.

--

Accordingly we suspend Mr Coleman from conclusion of racing on 14 February until after conclusion of racing on 22 February, 2009
