As Mr Grylls admitted the breach the Committee find the charge proved.
Penalty:
We grant Mr Grylls' request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, Mr Grylls had his license to ride in races suspended for a period to commence after racing on 14 December and conclude after racing on 21 December 2016 (3 days).
That period of suspension encompasses meetings at

Facts:
Following the running of race 7, Woods 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Grylls permitted his mount UNCOVERED to shift out near the 200 metres when not clear of LUCKY’S REVENGE and GREAT EXPECTATIONS which was checked.
Mr Grylls acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the incident using the available video footage. He pointed out Mr Grylls riding UNCONQUERED forward when it commenced to shift out under pressure near the 200 metres. He said this resulted in LUCKY’S REVENGE being crowded when dictated out by UNCONQUERED. He stated this in turn crowded and checked GREAT EXPECTATIONS who was racing on their outer.
Mr Coles identified on the head – on film that SPIDER had contributed to the interference when moving inwards. He acknowledged that Mr Grylls did make some attempt to straighten his mount and relieve the pressure but it was 2 strides too late.
Mr Grylls said he allowed his mount to drift out slightly and he tried to straighten his mount up but said it was a stride too late. He identified on the films SPIDER shifting in at that same point which contributed to the interference received by GREAT EXPECTATIONS.
Submissions for Penalty:
Mr Williamson produced Mr Grylls’ record which showed 1 previous breach under this Rule in the last 12 months which incurred a 3 day suspension. He said the level of carelessness was at the low end and agreed that SPIDER contributed to the incident when moving in. Mr Williamson said given it was a low level breach he believed an uplift from Mr Grylls’ previous 3 day suspension was not required.
Mr Grylls advised that he had upcoming engagements at Matamata on 14 December and any proposed suspension could start after that date. He said the degree of carelessness was low.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension which is adjusted based on the mitigating and aggravating factors.
The mitigating factors were Mr Grylls’ admission of the breach, his very good record and we deem the level of carelessness to be at the low end of the scale. When reviewing the films it was evident that SPIDER did contribute to the incident when GREAT EXPECTATIONS was crowded and checked. We accept that Mr Grylls did attempt to correct his mount but it was 2 strides too late.
The Committee accept that Mr Grylls does travel on a regular basis to the Central Districts for Industry days.
After taking into account all the above and placing emphasis on all the notable mitigating factors the Committee considers a 2 day discount was warranted on this occasion.
