Decision:

Following Race 7 an Information was filed pursuant to Rule 871 (1) (D) by the Informant Mr R Sanders.  He alleged that passing the 200 metres Mr J Collett allowed his mount KAMIKAZE FLYER to shift out continuing to take COLUMBIAN STRIKE (K Hercock) outwards, further taking the line of STRAIGHTTOTHEPOOLROOM (A Calder) which had to be checked.

Following Race 7 an Information was filed pursuant to Rule 871 (1) (D) by the Informant Mr R Sanders.  He alleged that passing the 200 metres Mr J Collett allowed his mount KAMIKAZE FLYER to shift out continuing to take COLUMBIAN STRIKE (K Hercock) outwards, further taking the line of STRAIGHTTOTHEPOOLROOM (A Calder) which had to be checked.

Mr J Collett was represented by his employer Mr R Collett.  Initially Mr J Collett denied the breach but later changed this to a guilty plea on the advice of Mr R Collett after viewing the films again and admitting he was only 1 length clear of Miss Hercock when taking her line.

Mr Sanders demonstrated the video films which clearly showed that 2 riders had contributed to the interference received by Mr Calder.  Firstly Miss Hercock moved out when not clear for which she has already been charged, and then Mr J Collett moved out in turn taking Miss Hercock’s line when not the required distance clear.

Miss Hercock was called as a witness who was before Mr Collett changed his plea.  She said she stopped riding for 4 strides when she had her line taken by Mr Collett who she said was only half a length clear of her but going past her quite quickly.

At this point Mr J Collett changed his plea to guilty.

PENALTY SUBMISSIONS

Mr Sanders produced Mr Collett’s record which he described as fair.  However as in Miss Hercock’s case there were mitigating factors in Mr Collett’s favour which have already been described.  He submitted that the carelessness was at the low end and a minimum suspension would be appropriate.

Mr R Collett said Jason had followed Miss Hercock out and did straighten his mount although a little late.  He said Jason had commitments until 13 April 09.

PENALTY

--

The Committee considered all submissions and as in Miss Hercock’s case found mitigating factors in Mr Collett’s favour.  These are namely his guilty plea, contribution from 2 riders to the incident and his level of carelessness which we consider to be at the low end.

--

Accordingly we suspend Mr J Collett from race riding after the conclusion of racing on 13 April 09 and conclude after racing on 18 April 09 (4 days)
