Following the running of Race 6 at Ellerslie on Wednesday 7 March, an information was preferred against Mrs L Satherley alleging careless riding pursuant to Rule 871(1)(d) of the Rules of Racing. Mrs Satherley admitted the charge which is therefore deemed to be proved.

Mr A Coles demonstrated the incident on the front on and side on cameras. The incident complained of was that Mrs Satherley moved inwards when not her own length, but another length clear as is required by the Rules of Racing, causing a significant check to "Genuine Offer" ( R Norvall) which resulted in both "Genuine Offer" and "Velvet & Satin" (C Lammas) being severely crowded. Mr Coles was of the view that Mrs Satherley was only about ? of a length to a bare length, if that, prior to making her inwards movement.

Mrs Satherley commented that she believed all she caused was some tightening. She did not hear anybody calling out from behind her and believed that Mr Norvall has said that his horse was lugging in, and she was of the view that no-one had to "check out of it". Mr George, in response, said that the onus is on riders to be clear at all times. He again pointed out that Mr Norvall lost his running line and had to then move around to renew his running position.

Mr George then submitted to us that in so far as Mrs Satherley's riding record was concerned, that she was suspended for three days on 7 December 2006. Mr George believed that a suspension was an appropriate penalty and opposed the imposition of a fine.

Mrs Satherley pointed out to us that she thought that the degree of carelessness was not at the higher end of the scale and that she felt that the matter could be dealt with by way of a fine. She also stated that she had a horse to ride in the New Zealand Oaks on 17 March, and that she wished to hold the connection in that regard as she does not get much of an opportunity to ride in Group 1 races.

PENALTY DECISION

In imposing penalties, it is incumbent on us to impose penalties which are consistent with the general penalty regime. In our opinion, careless riding such as the degree of Mrs Satherley's careless riding on this occasion, calls for a suspension. A fine is not an option.

The degree of carelessness was middle of the range. Contrary to what Mrs Satherley said, Mr Norvall did receive quite a significant check and there was other crowding, as referred to in the information to "Velvet & Satin".

We are conscious of the fact that Mrs Satherley wishes a fine to be imposed and of her submission that she wishes to maintain her ride in the Oaks at Trentham on 17 March. However, that would involve the imposition of a penalty which would be too short in all of the circumstances.

Therefore, we believe that a period of suspension is an appropriate period. Mrs Satherley is therefore suspended from race riding from the conclusion of racing on Saturday 10 March 2007 until the conclusion of racing on Wednesday 21 March. That is a four day suspension.
