Decision: Following Race 4 an information was filed pursuant to rule 871 (1) (d) by the informant Mr A Coles. He alleged that near the 250 metres SCARLET VANHARA (M Coleman) angled out when not clear of KARLOUSHE
Following Race 4 an information was filed pursuant to rule 871 (1) (d) by the informant Mr A Coles. He alleged that near the 250 metres SCARLET VANHARA (M Coleman) angled out when not clear of KARLOUSHE (B. Jones) causing that horse to be checked and hampering AFFAIROFTHEHEART (T. Harris).

Mr Coleman admitted the charge.

Mr J. Oatham demonstrated the video films which showed Mr Coleman racing at the rear of the field and looking for room, he angled his mount SCARLET VANHARA out at the 250 metres mark when not the required distance clear, and in doing so take the line of KARLOUSHE (B Jones), AFFAAIROFTHEHEART (T Harris) causing interference to both horses.

Mr J Oatham stated that Mr Coleman’s mount was running on well when he angled out and was committed to a run to his outside prior to the interference occurring. He stated that NEVAEH ridden by M Hills had rolled out slightly as Mr Coleman had committed to a run.

Mr Coleman stated he was in an awkward position and could not make his run back to the inside as he was committed to the outside. He admitted it was an error of judgment.

Mr Coles said that Mr Coleman had a good record with 2 charges in the last 12 months. He confirmed the video evidence of Mr Oatham was correct. He submitted a 4 day suspension would be appropriate.

Mr Coleman said that he had commitments up to and including Ellerslie on 14.12.08.

The committee carefully considered all submissions and before imposing a penalty took into account :

1. His guilty plea.
--2. Mr Coleman’s good record.
--3. Mr Coleman’s riding commitments.
--4. Mr Coleman would miss a premier raceday
----
Accordingly the committee imposed a suspension to be served by Mr M Coleman starting after racing on the 14th December and to conclude after racing on the 20th December 08. (4 days)
