As the breach was admitted we find the charge proved.

Penalty:

After taking all the above factors into account and pursuant to rule 1106 the committee imposes a suspension on Mr Waddell from riding in races which is to start after racing on 5 November and conclude after racing on 11 November 2011 (5days).  In additon and because this is a group 3 race we impose a fine of $250.

Facts:

Following race 6 the informant Mr C George alleged that Mr J Waddell permitted his mount DAWN GHOST to shift outwards near the 350 metres when not sufficiently clear of INSURGENT which was checked. 

Submissions for Decision:

Mr Oatham demonstrated the video films which showed DAWN GHOST racing in a 3 wide position approaching the 350 metres. 

At this stage she was directly behind RED RULER with INSURGENT on her outside.  Mr Oatham pointed out Mr Waddell, riding DAWN GHOST, push out into the line of INSURGENT to gain a clear run.  It was clearly evident that Mr Waddell was not the required distance clear of INSURGENT which had to be checked and lose its rightful line of running. 

Mr Waddell in admitting the charge said he was just trying too hard.

Submissions for Penalty:

Mr George said Mr Waddell had incurred 1 charge in the last 12 months.  He said Mr Waddell's carelessness was mid range and asked the committee to consider that this was a group 3 race.  He submitted a supsension of 5 days and a fine in the region of $150 - $250 would be appropriate.

Mr Waddell said he had commitments up to and including November 5. 

Reasons for Penalty:

The committee carefully considered all submissions and evidence as presented.  Mitigating factors are Mr Waddell's admission of the breach and his good record.  However these factors must be balanced against the following aggravating facts.  This was a group 3 race in which Mr Waddell gained an advantage by pushing out when insufficiently clear and finishing in 3rd position.  The committee finds his carelessness to be mid range.
