Facts:
Following race 3 an information was filed pursuant to rule 610 (2) (a). The informant Mr C George alleged that Mr J Collett wore an unapproved body protector.
Submissions for Decision:
Mr George explained to the committee that Mr Collett had come to the stewards early in the day to ask for approval to wear a vest currently unapproved in New Zealand. Mr George explained to Mr Collett that although these vests were approved in Australia that was not the case in New Zealand and they were not to be worn until such approval was granted.
Mr Collett told the committee he had changed into this vest because he admitted to being a bit heavy in a previous race.
Submissions for Penalty:
Mr George said there had been no previous issues with Mr Collett regarding vests. However he was concerned that Mr Collett had deliberately flouted the rules in front of the stewards and submitted a $500 was justified.
Mr Collett had nothing to say regarding penalty.
Reasons for Penalty:
The committee explained to Mr Collett they were aware that previous standard penalties for wearing unapproved vests had incurred fines of $200. In this case however Mr Collett was told the vest in question did not comply in New Zealand and he was not to wear it until approval was given. Mr Collett deliberately chose to ignore this instruction, an action which the committee views seriously. The committee does take into account however that Mr Collett admitted the breach and this was his first charge under this rule.
