Information 5208 alleged a breach of Rule 871(1)(d) for careless riding by Jockey A J Calder (CLARISSA) in that he allowed his mount to shift in when not the required distance clear into the rightful line of running of SADIE BELLE (M Walker) who checked and was forced into the line of FOCAL POINT (C Ormsby) who also checked and dropped back causing interference to KIND REGARDS (V Colgan).

The breach was admitted.

Assistant Stipendiary Steward T Treweek demonstrated the incident on video and he pointed out the details and identified the runners as Mr Calder angled in shortly after the start when not clear. The resulting checks were obvious although the initial movement in was, he said, only a horse width.

Mr Coles submitted that it was an error of judgment on Mr Calder's part. He was a popular rider with an otherwise good record. His last breach of this rule had been in July 2005 at Paeroa when he was suspended for three days. Mr Coles submitted that the Committee should likewise consider dealing with this incident by way of a suspension.

Mr Calder asked that credit be given for his record and admission of this breach and that as he had heavy commitments coming up at Riccarton and in particular an engagement for VEGAS SHOWGIRL in the 2000 Guineas consideration be given to deferring any suspension or imposing a fine.

After taking these matters into account the Committee finds that a suspension should be imposed which must take effect following the Paeroa meeting on 2 November 2005. It would not be appropriate to defer the suspension or impose a fine in the circumstances but in ordering suspension from the conclusion of racing on 2 November 2005, as we do, until after the conclusion of racing on 8 November 2005 the three days involved will be Saturday (Riccarton), Sunday (Tauherenikau) and Tuesday (Otaki).
