Decision:

Following Race 9 the Informant Mr Sanders filed a charge pursuant to Rule 871 (1) (D).  He alleged that Mr Colgan permitted his mount JUNGLE BOOTS to shift inwards near the 2100 metres when not sufficiently clear of DOWN THE ROAD (M Coleman) who was dictated inwards into the line of EASY RIDER (S Arnold) who was severely checked.

Following Race 9 the Informant Mr Sanders filed a charge pursuant to Rule 871 (1) (D).  He alleged that Mr Colgan permitted his mount JUNGLE BOOTS to shift inwards near the 2100 metres when not sufficiently clear of DOWN THE ROAD (M Coleman) who was dictated inwards into the line of EASY RIDER (S Arnold) who was severely checked.

Mr Colgan admitted the breach.

Mr Oatham demonstrated the video films which showed at a point soon after the start, Mr Colgan (JUNGLE BOOTS) angle his mount in from Barrier 11 towards the rail.  He then steadied his mount before again allowing his mount to move in sharply and into the line of DOWN THE ROAD (M Coleman) who was in turn forced across into the line of EASY RIDER (S Arnold) who was severely checked.

Mr Colgan while admitting the breach said he pushed forward and his mount started over racing.  He said he got himself into trouble, eased up and was basically out of control.

PENALTY SUBMISSIONS

Mr Colgan said he had commitments up until March 7.

Mr Sanders produced Mr Colgan’s record which showed that this was his 3^rd charge in the 2 months of the year.  He submitted this offence was at the higher end of the spectrum and was in NZ’s richest race.  He said this warranted a penalty of 3-4 weeks and a fine of $2000 - $3000.

PENALTY

The Committee carefully considered all submissions and before imposing a penalty took into account the following:

• Mr Colgan’s guilty plea
--
• His record which is of some concern of late
--
• Status of the race and implications of Rule 1122
--
• Level of carelessness and the severity of the checks received by DOWN THE ROAD and EASY RIDER

Finally the Committee must be cognizant of the fact that this is NZ’s richest race and along with the above factors believe that a deterrent penalty be imposed.  Accordingly we impose a suspension to start after racing on March 7 and conclude after racing on April 7 2009.  In addition we impose a fine of $2500.
