Decision: Following Race 9 an information was filed pursuant to Rule 871 (1) (d) by Chief Stipendiary Steward Mr C George.  He alleged that Ms S Spratt permitted her mount PRINCE KAAPSTAD to shift inwards approximately 200 metres after the start when not sufficiently clear

Following Race 9 an information was filed pursuant to Rule 871 (1) (d) by Chief Stipendiary Steward Mr C George.  He alleged that Ms S Spratt permitted her mount PRINCE KAAPSTAD to shift inwards approximately 200 metres after the start when not sufficiently clear of ABITOFADO (M Wenn) crowding that runner in onto SIRCROSS (L Innes) who in turn was taken in across the line of SING SONG GIRL (A Calder) which was checked.

Ms Spratt did not admit the charge and was represented by her employer Mr R Yuill.

Stipendiary Steward Mr J P Oatham demonstrated the video films and showed where just before the 200 metre mark Ms Spratt moved across and took the line of Ms Wenn on her inside when insufficiently clear of that runner.  This in turn put pressure on Mr Innes, riding SIRCROSS, who was forced across into the line of Mr A Calder (SING SONG GIRL) who received quite a severe check.

Mr Yuill called Mr Calder, as a witness, who said that it was tight on the inside prior to the incident but he did have one horse width to race in.  He agreed the interference was caused by pressure from the outside.

Mr Yuill said in his statement that Mr Innes tightened Mr Calder before Ms Spratt came across thereafter he said she kept a straight line.

Ms Spratt concurred with Mr Yuill’s statement.

Mr George said that there was always room for three horses on the inside of Ms Spratt if she had maintained her correct line of running.  He reiterated that Ms Spratt was not the required distance clear when she made her inward movement.

DECISION:

--

The committee carefully considered all the evidence and are clearly satisfied that Ms Spratt did move in and take the line of Ms Wenn when not the required distance clears of that runner.  This resulted in crowding to the three inside runners with Mr Calder on the rail receiving quite a severe check.  Accordingly we find the charge proven.

PENALTY

--

Mr George produced Ms Spratt’s record which shows 7 suspensions in the last 12 months.  He said that he had spoken to all riders warning them of the consequences should they breach the rules in a race of this status.  He asked for a penalty of 2 – 4 weeks and a fine of $4,000 - $6,000.

Mr Yuill asked the committee to consider the penalty received by Mr M Du Plessis in the Million Dollar Race and the consequences to three runners at the finish.

After considering all submissions we took into account the following:

--

1.         Ms Spratt’s record which we told her was of concern.   We considered that seven suspensions in 12 months is a poor record, and in fact only yesterday Ms Spratt had incurred a six day suspension while riding at Riccarton.

--

2.         While we concede the degree of carelessness was not high, consequences were, that Mr Calder received a severe check.

--

3.         The status of the race and Ms Spratt’s obligations under Rule 1122.   It is important to note that prior to this Group One race riders were warned they could expect up to one months suspension if found guilty of a breach of the rules.

We note Ms Spratt is shortly to commence a suspension concluding on 19 March 2008.  Therefore we suspend Ms Spratt from the 20th of March until the conclusion of racing on 4th April 2008 (10 days), and impose a fine of $4,000.

Decision:
