As the breach was admitted by Mr Coleman it was found to be proved by the Judicial Committee.

Penalty:

Mr Coleman’s Jockeys License was suspended from the close of racing on 3 January 2017 up to and including racing on 14 January 2017 (4 days).

Facts:

Following the running of Race 6 (2016/2017 Dunstan Feeds Stayers Championship Final), Information No.A8651 was filed with the Judicial Committee. Mr Oatham alleged that Mr Coleman, the rider of BANROCK allowed his mount to shift out when not sufficiently clear of DIESEL which was checked near the 400m.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless

Mr Coleman acknowledged that he understood the Rule, charge and confirmed that he admitted the breach.

Stipendiary Steward, Mr Williamson showed all relevant film replays and said that near the 400m Mr Coleman and his mount BANROCK shifted out when not clear which resulted in DIESEL being crowded and checked.

Mr Coleman said that he did shift into the line of DIESEL, but at the time he thought that there was room to do so. He said that it was an error of judgment on his part.

Submissions for Penalty:

Mr Oatham said that Mr Coleman had a relatively good record, in that he had only two prior breaches of the Rule during the past 12 months. He said that the carelessness, in the opinion of the Stewards, was below mid-range. He said that earlier in the day another rider had been suspended for 4 riding days for a similar breach and submitted that a penalty in line with that suspension would be appropriate.

Mr Coleman said that the only engagements he had was for Tauranga the next day. In answer to a question from the committee, Mr Coleman said that he had not often ridden in the Central District region during the last 6 months.

Reasons for Penalty:

The Committee, after giving the matter due consideration, determined that the carelessness exhibited by Mr Coleman was below mid-range. After taking into account the admission of the breach, good record and the JCA starting point of 5 riding days suspension for careless riding the committee believed that an appropriate penalty was one of 4 riding days. The committee noted that two of the days were Premier fixtures.

(Central District industry days were not included as Mr Coleman did not have a history of riding at those meetings in recent times).
