As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above facts into account and under the provisions of Rule 1106 (2), we impose a suspension on Mr Rawiller from riding in races which is to start after racing on 4 January and conclude after racing on 13 January 2012 (6 days). In addition we impose a fine of $1000.

Facts:

Following race 8 an information was filed pursuant to rule 638(1)(d). The informant, Mr George alleged that Mr N Rawiller permitted his mount ATOMIC FORCE to shift inwards near the 300 metres when not sufficiently clear of DURHAM TOWN (V Colgan) which was checked.

Submissions for Decision:

Mr George demonstrated the video films which showed ATOMIC FORCE racing wide on the track approaching the 300 metres. He pointed out to the committee Mr Rawiller allowing his mount to move in ¼ to ½ horse widths taking the line of DURHAM TOWN when insufficiently clear. This caused Mr Colgan to check off the heels of ATOMIC FORCE and lose considerable momentum.

Mr Rawiller, in admitting the charge said he did move in slightly but they were racing in restricted room at the time. He submitted that Mr Colgan had put himself in an awkward position and his mount DURHAM TOWN appeared as though it did not want to be there.

Submissions for Penalty:

Mr George had access to Mr Rawiller’s Australian riding record which he submitted was a good one. He believed Mr Rawiller’s carelessness today was at the low end of the scale. However the repercussions to DURHAM TOWN were significant which affected his chances considerably. He said that as this was a Group 1 race, which Mr Rawiller went on and won, a minimum suspension of 5 days and a fine of $1000 - $1500 would be appropriate.
Mr Rawiller submitted his carelessness was at the low end and he had commitments up to and including 4 January 2012.

Reasons for Penalty:

The committee carefully considered all submissions and evidence. Mitigating factors are, Mr Rawiller’s admission of the breach and his good record. After reviewing the video films, we find Mr Rawiller’s carelessness to be at the low end as he only moved in a minimal amount. However DURHAM TOWN’S chances were adversely affected as a result of the check. The status of the race being a Group 1 was also significant in our penalty consideration.
