As the breach was admitted we find the charge proved.
Penalty:
After taking all the above factors into account we impose a suspension on Mr Bradley from riding in races which is to start after racing on 4 January and conclude after racing on 12 January 2011 (4 riding days).

Facts:
Mr Oatham demonstrated the video films which showed Mr Bradley riding KING RAEDWALD, racing in a 2 wide position soon after the start. Approaching the 1400 metres it was evident on the films that Mr Bradley allowed his mount to shift in and into the line of IRISH OPERA (L Innes) when insufficiently clear.

Mr Oatham said Mr Innes had to check his mount and at no point was Mr Bradley clear when moving in.
Mr Bradley, while freely admitting the charge, stated that his mount was racing in blinkers and seemed to get a fright when horses outside him started moving in. Mr Bradley said he was happy to stay one off the rail and he did not steer his mount in. He admitted however he could have done more to correct his mount.
Submissions for Penalty:
Mr George produced Mr Bradley's record which showed only one suspension in the last 12 months. Mr George confirmed Mr Bradley was a national rider and submitted a 4 -5 day suspension would be appropriate.
Mr Bradley said he had commitments up to and including 4 January 2011.
Reasons for Penalty:
It was explained to Mr Bradley that the starting point for a careless riding charge was now 5 days with mitigating and aggravating factors taken into account in determining an appropriate penalty. The committee carefully considered all evidence and submissions. Mitigating factors include Mr Bradley's excellent riding record and his admission of the breach. We have also considered Mr Bradley's submission that his horse overreacted to the movement of runners on his outside. However the committee is satisfied that the interference to Mr Innes was more a result of an error of judgement on Mr Bradley's part thinking he was clear when moving in.
