As the breach was admitted we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Peard from riding in races which is to start after racing on 5 January and conclude after racing on 15 January 2011 (5 riding days).

Facts:
Mr Oatham demonstrated the video films and pointed out to the committee Mr Peard riding ZARA DANCER racing in a 2 wide position approaching the 300 metres. From here it was clear on the films that Mr Peard angled his mount towards the rail to gain a better run. It was evident that in doing so ZARA DANCER made contact with DON DOMINGO whose rider, Mr V Colgan, was forced to turn his mount's head to resist the pressure of ZARA DANCER. This resulted in both horses receiving severe checks.
Submissions for Decision:
Mr Oatham conceded MR SHANGAI had rolled in slightly but did not contribute to the interference.
Mr Peard admitted he had made a bad decision when he elected to move in but said MR SHANGAI contributed slightly. However he admitted he had reacted too late.

Mr George said Mr Peard had incurred 2 charges in the last 12 months. However he said 2 horses had received checks in this incident and submitted Mr Peard's carelessness was at the higher end.
Mr Peard said he had commitments up to and including 5 January 2011 and confirmed to the committee he did not ride in the South Island.
Reasons for Penalty:
The committee considered all the evidence and submissions. Mitigating factors include Mr Peard's admission of the breach and his good record. However these are outweighed by the severity of interference received by 2 horses. Mr Peard clearly went for a run where there was insufficient room. Mr Peard was told the starting point for careless riding was now 5 days with mitigating and aggravating factors considered before arriving at an appropriate penalty. Without the mitigating factors in this case the committee believes this charge would have warranted 6 days. However taking these factors into account we have reduced this to one of 5 days.
