Following race 5 a protest was lodged by Stipendary Steward Mr J Oatham pursuant to Rule 876(1) when it was alleged that VALHALLA placed 1st by the judge caused interference to TARBACH placed 2nd by the judge. This interference occurred in the final straight.

Stipendary Steward Mr M Williamson demonstrated the video films which clearly showed that at the 150 metre mark VALHALLA moved out approximately 2 horse widths dictating the line of TARBACH on his outside when not the required distance clear.

Mr Cooksley, rider of TARBACH, said his line was dictated by VALHALLA. He claimed that he lost at least a neck.

--

Ms Whiteside said that the head-on video showed that her horse was inconvenienced and lost momentum.

--

Mr Taylor, rider of VALHALLA, said he moved out ½ a mowing strip. He said that Mr Cooksley never stopped riding TARBACH and in fact he, Taylor, had to stop riding and rebalance his mount.

Mr Rayner said that VALHALLA had lost momentum when Mr Taylor straightened his mount.

--

Mr Oatham said that there was clear interference at the 150 metre mark when VALHALLE moved 2 horse widths into the line of TARBACH which was denied his rightful line of running causing it to lose momentum. He submitted that the protest be upheld.

DECISION: The committee carefully considered all of the evidence presented before it and are clearly of the opinion that had TARBACH not received interference from VALHALLA it would have won the race.

--

Critical to the decision was the nose margin at the finish, the manner in which TARBACH was finishing, and the amount of ground that he lost as a consequence of the interference.

--

Accordingly the protest is upheld and the placings are now
