Following the running of Race 3, the Stella Artois Eclipse Stakes, Chief Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 871(1)(d) alleging Apprentice Jockey C. J. Grylls rode carelessly.

DECISION AND REASONS:
--Following the running of Race 3, the Stella Artois Eclipse Stakes, Chief Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 871(1)(d) alleging Apprentice Jockey C. J. Grylls rode carelessly.
--Before the hearing commenced Mr George explained that Mr Grylls’ employer (Mr Sanders) could not attend the hearing. After discussions between Mr Cameron and Mr Sanders it was agreed that Mr Grylls could attend on his own. Mr Grylls confirmed that he was happy to attend the hearing without assistance.
----Mr Grylls had indicated on the information that he admitted this breach of the Rules, and he confirmed this at the hearing. Mr Grylls also acknowledged that he understood the Rule and the charge.
--This incident was illustrated by means of video coverage, and showed that Mr Grylls had moved inwards as described in the information, and that as a result "Explosive Dancer" had been checked. Mr Grylls accepted the summary of this incident as given by Mr George.
--PENALTY:
--In relation to penalty Mr George advised that Mr Grylls has had two 3 day suspensions for careless riding since August 2007, and that in this respect his record was quite good for a busy rider. Mr George also said that the degree of carelessness was not the most serious, but that the status of the race (Group 3) and the stake payable ($75,000) had to be taken into account in accordance with Rule 1122(2). Mr George recommended that a suspension of 4 to 5 days coupled with a fine of between $500-00 and $1000-00 would be appropriate in this case.
--Mr Grylls had no submissions to make in relation to penalty. He did advise that he had commitments to ride at Thames on 4 January 2008, and asked (see Rule 1305(2)) that the suspension start after that date. Mr George agreed with this.
--We adjourned to consider the matter of penalty.
--DECISION ON PENALTY:
--When considering an appropriate penalty we took into account that Mr Grylls’ riding record was accepted by Mr George as being relatively good. It was also to Mr Grylls’ credit that he admitted this breach of the Rules. On the other hand we were required to take into account the status of the race and stake payable in this race.
--We were satisfied that the range of penalties suggested by Mr George was appropriate, and on returning to the Enquiry Room we advised that Mr Grylls was suspended from race riding from 5 to 11 January 2008, both dates inclusive, this being a 5 day suspension. In addition Mr Grylls was fined the sum of $500-00.
