Following Race 7 an information was filed pursuant to Rule 876(1) by the informant, Mr Cameron, alleging that SO YOU placed second by the judge, interfered with the chances of WILLY SMITH

DECISION AND REASON:

--

Following Race 7 an information was filed pursuant to Rule 876(1) by the informant, Mr Cameron, alleging that SO YOU placed second by the judge, interfered with the chances of WILLY SMITH, placed third by the judge. The interference occurred near the 200-metre mark.

--

The margin, Mr Cameron the informant demonstrated the video films and showed that between second and third was a long neck.

--

All connections were informed of the protest. WILLY SMITH was represented by trainer, Mr M Todd and rider Mr M Cameron. SO YOU was represented by owner, Mr T Hobson, trainer Mr P Duncan and rider Mr M Coleman.

Nearing the 200-metre mark Mr Cameron, rider of WILLY SMITH, demonstrated where SO YOU on his inside move out into his line, which caused him to check his mount and lose momentum. He believed it cost him second placing, given the margin of a long neck between second and third.

Mr Todd, trainer of WILLY SMITH, said he saw his horses head come up and that had SO YOU kept its correct line, in his opinion, WILLY SMITH would have finished second.

--

Mr Coleman, rider of SO YOU, said the interference to WILLY SMITH was contributed to by UPSTAGED moving out which caused him to move into the line of WILLY SMITH.

--

Mr P Duncan, trainer of SO YOU, confirmed Mr Coleman's evidence saying UPSTAGED moved out contributing to the interference.

--

Mr T Hobson, owner of SO YOU, also believed this evidence to be relevant with the outward movement of UPSTAGED.

--

Decision:

--

The committee carefully considered all evidence and are satisfied that interference did occur near the 200 metre mark when SO YOU moved out into the line of WILLY SMITH when insufficiently clear of that runner.

--

The committee was satisfied that the chances of WILLY SMITH finishing in a better place were affected.

--

In applying their discretion the committee gave careful consideration to the following ?

  1. The degree of interference suffered by WILLY SMITY.
  2. --
  3. The margin of a long neck between second and third.
  4. --
  5. The stage of the race when the interference occurred and the strong manner in which he finished the race.

Accordingly, the committee upheld the protest and the placings shall now be ?
