Following Race 8, the Railway Handicap, an information was filed pursuant to Rule 912(1) by Stipendiary Steward Mr A Coles requesting a ruling on whether the horses SEDECREM and/or MAGISTRA DELECTA were denied a fair start.

Following Race 8, the Railway Handicap, an information was filed pursuant to Rule 912(1) by Stipendiary Steward Mr A Coles requesting a ruling on whether the horses SEDECREM and/or MAGISTRA DELECTA were denied a fair start.

--

Present at the hearing was Mr McKeon, rider of MAGISTRA DELECTA, and Mr G Cooksley, rider of SEDECREM. Also present was starter, Mr T Harrison.

Mr McKeon said in his evidence that prior to the start his mount was unsettled and attempted to go under the gate. He called for assistance and then got back into the saddle. He tried to straighten his mount up and called twice "No" to the starter indicating he was not ready. At that stage and a split second before the gates opened he pushed to the side and flopped out. In response to questions, he confirmed he was denied a fair start and was not slow away of his own accord. He was still receiving assistance just prior to the gates opening.

Mr Cooksley, rider of SEDECREM said he observed an assistant up with MAGISTRA DELECTA just prior to the start and his opinion was trouble started split seconds before the gates opened.

Once the gates opened MAGISTRA DELECTA pushed over on top of SEDECREM completely denying Mr Cooksley a fair start.

Mr T Harrison confirmed the gates did not mal-function but observed MAGISTRA DELECTA pushing over side-ways onto Mr Cooksley once the gates had opened.

Decision:

After hearing all evidence and carefully viewing the video films the committee is satisfied that SEDECREM was denied a fair start, by the actions of MAGISTRA DELECTA pushing sideways into him.

The committee was also satisfied that MAGISTRA DELECTA was denied a fair start in the race. Mr McKeon was in obvious trouble before the gates opened and called to the starter on two occasions that he was not ready. There was also an assistant up with the horse prior to the gates opening. The key element in the committee's decision was that the trouble started prior to the gates opening, accordingly they were satisfied both horses were denied a fair start and not just slow away of their own accord. There were contributing factors as set out above.

Accordingly, the committee ordered a refund of all investments on each horse.
