Following Race 4 an information was filed pursuant to Rule 876 (1). The informant, Jockey Mr T Hazlett, alleged that SMOKE, placed 1st by the judge, caused interference to ZAGATA, placed 2nd by the judge, in the final straight. The margin between 1st and 2nd was ¾ length.
--All connections were informed of the Protest.

--Mr Hazlett demonstrated the video films and showed that on separate occasions SMOKE moved out on him. He said he was racing in the middle of the track to keep clear of other runners as he was easily distracted. He considered the three bumps cost him more than the ¾ length margin at the post. He added that Mr Durdon did not stop riding or straighten his mount.
--Mr Lucock, trainer of ZAGATA, confirmed Mr Hazlett’s remarks particularly that ZAGATA was easily distracted.
--Mr Durden, rider of SMOKE, said he came from behind ZAGATA after the last fence and he said the bumps were only brushes and at no stage did Mr Hazlett have to stop riding.
--Mr Brosnan, trainer of SMOKE, agreed with Mr Durden’s comments.
--Mr Hazlett, in his summing up, re-affirmed he was in the middle of the track and SMOKE came out on to him.
--Stipendiary Steward Mr A Coles, when asked for his assessment, said there were 2 slight bumps but at no stage did Mr Hazlett stop riding or have his line taken. He believed the placings should stand.
--DECISION
--The Committee carefully considered all evidence and while we concede that SMOKE did move out and brush ZAGATA on three occasions, we do not believe this cost ZAGATA the chance of beating SMOKE. Relevant in this decision was :
--1. The ¾ length margin at the post.
--2. Mr Hazlett did not stop riding.
--3. ZAGATA’s line was not taken at any stage.
--Accordingly, the judge’s placings shall stand and the protest is dismissed.
