Decision:
Following the running of Race 7, Golden Stockfoods Ltd Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against GLOBE TOWN (G D O’Reilly), placed 5th by the judge, on the ground that it “broke over the concluding stages being lapped onto the 6th place, LATE ARRIVAL (A J Laing)”.
DECISION AND REASONS:
--Following the running of Race 7, Golden Stockfoods Ltd Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against GLOBE TOWN (G D O’Reilly), placed 5th by the judge, on the ground that it “broke over the concluding stages being lapped onto the 6th place, LATE ARRIVAL (A J Laing)”.

Mr J R Stackhouse, owner and trainer of GLOBE TOWN, had endorsed the information - “The connections do not contest the protest” – and had signed it.

Rule 870 provides as follows:
--(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses. . .

Mr McIntyre showed a video replay of the concluding stages of the Race. He pointed out GLOBE TOWN go into a break, be taken hold of by its driver and lose ground in the break. However, it continued in a gallop, for approximately 40 metres, to the finishing line and was lapped on by the 6th placed horse, LATE ARRIVAL. Mr McIntyre also produced the official photo finish of the Race which clearly showed GLOBE TOWN in a gallop when its nose reached the finishing line and being lapped on by LATE ARRIVAL.

Accordingly, the protest was upheld and GLOBE TOWN was relegated to 6th placing, with LATE ARRIVAL being promoted to 5th placing.

Consequent upon the relegation, the amended result for the Race is as follows:
--1st 11 Steph’s Caesar
--2nd 16 Johnny Bravo
--3rd 18 Vienna Bromac
--4th 7 Soky’s Okay
--5th 4 Late Arrival
