Facts:
Following the running of Race 1, the Ashburton Trotting Club Mobile Trot, an Information Instigating a Protest was filed by Stipendiary Steward Mr N Ydgren alleging a breach of Rule 870(5), the lapped on rule, in that 1st placed horse “Topnotch Jewel”(8) driven by Mr D J Dunn, broke from its gait shortly before the winning post and was lapped on by the 2nd placed horse ”Quartet”(10) driven by Mr R T May.

The information reads as follows:
This is a protest by horse number (10) placed 2nd by the judge against horse number (8) placed 1st by the judge under Rule 870 (5), lapped on, when “Topnotch Jewel” broke short of the post being lapped on by “Quartet”.
Rule 870 (5) provides as follows:
”Notwithstanding the provisions of sub-rule(4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule869(8) such relegation of the horse shall be at the discretion of the Judicial Committee."
The connections of ”Topnotch Jewel”, trainer Mr J Gameson, advised the Stipendiary Stewards that he did not contest the protest and he did not attend the hearing.

Video coverage of the final stages of the race was shown to illustrate that late in the run home ”Topnotch Jewel” broke from its gait and galloped over the final stages of the race. Stipendiary Steward Mr Ydgren estimated that “Topnotch Jewel” broke from its gait approximately 20m prior to the line. The margin between 1st and 2nd was a nose.
Reasons for Decision:
As the protest was not contested “Topnotch Jewel” was relegated to 2nd place.
