Decision:

Following the running of Race 2, the Mountain View Equine Ltd Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr K. V. Hadfield, the driver of “Mullingar Mac” (10), under Rules 869(4) and (6)(b) and (c) alleging a breach of the “push out” rule with about 1600 metres to run.

Following the running of Race 2, the Mountain View Equine Ltd Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr K. V. Hadfield, the driver of “Mullingar Mac” (10), under Rules 869(4) and (6)(b) and (c) alleging a breach of the “push out” rule with about 1600 metres to run.

There had already been a hearing of the protest against “Mullingar Mac’s” 2nd  placing, and Mr Hadfield admitted this breach of the Rules, and agreed the evidence heard during the protest hearing should form the basis for this hearing.

Neither Mr Ydgren nor Mr Hadfield had any other matters they wished to add to the evidence from the original hearing.

Mr Ydgren advised that the Mr Hadfield had no previous relevant convictions and a fine of $200-00 was recommended.  The matter of penalty was discussed and Mr Hadfield said that he would prefer a suspension to a fine.  Mr Ydgren accepted that a suspension could be considered, and that it should be a two day suspension.

We were satisfied that a suspension was an appropriate penalty in this case.  Accordingly Mr Hadfield’s Open Horseman’s Licence was suspended from after the conclusion of racing on 4 March 2009 until after the conclusion of racing on 12 March 2009, this being a two day suspension.
