Following the running of Race 7 an information was filed by Chief Stipendiary Steward Mr N R Escott against licensed driver Mr J C Hay alleging that Mr Hay used his whip excessively in the run home.

Following the running of Race 7 an information was filed by Chief Stipendiary Steward Mr N R Escott against licensed driver Mr J C Hay alleging that Mr Hay used his whip excessively in the run home. The information was signed off by the Registrar at 3.45 pm on race day. Due to Mr Hay's unavailability, the Hearing was adjourned to 4 June 2007.

At the outset of the Adjourned Hearing the Registrar confirmed that he had discussed with Mr Hay his plea and attendance and that he had confirmed to the Registrar that he admitted the breach and did not wish to be present and, in respect of penalty, would prefer a suspension. Mr Escott in respect of penalty, asked the Committee to note that on 11 November 2006, on Show Day at New Zealand Metropolitan Trotting Club Meeting, Mr Hay was fined $450 under this Rule. Mr Escott indicated that the Stipendiary Stewards were seeking a suspension in the vicinity of 3 to 4 days.

It was noted from the information that Mr Hay indicated that he intended to drive at the Nelson/Forbury/Blenheim meetings over the next two weeks.

Having given consideration to the submissions, the Committee finds that a suspension is appropriate and accordingly Mr Hay's horseman's licence is suspended from the completion of racing today, 4 June 2007 until the completion of racing on 10 June 2007 (an effective 3 days).
