Following the running of Race 3 an information was filed by Stipendiary Steward Mr N Ydrgen alleging that Ms A Tomlinson drove carelessly in the run home on Midnight Invasion

DECISION & REASON

--

Following the running of Race 3 an information was filed by Stipendiary Steward Mr N Ydrgen alleging that Ms A Tomlinson drove carelessly in the run home on Midnight Invasion in that she allowed her horse to strike the sulky of Monaro Miss racing ahead of her. Ms Tomlinson was present at the Hearing of the information and confirmed the breach was admitted. The breach is accordingly found proven. Mr Ydrgen demonstrated the incident with the assistance of the video replays and asked the Committee to note showed Ms Tomlinson's horse racing strongly behind Monaro Miss and then striking its sulky as she attempted to get a run.

Ms Tomlinson for her part said that the horse was racing strongly, it was a large horse and she simply misjudged the space available.

Mr Ydrgen indicated that over the last 12 months there were no charges under this Rule against Ms Tomlinson and asked the Committee to note that the horse she was driving was 4th favourite and lost its chance. Mr Ydrgen indicated that the Stipendiary Stewards were seeking a suspension and Ms Tomlinson did not oppose this. In respect of upcoming race drives, Ms Tomlinson said she would be driving on the Nelson circuit and possibly then returning to Blenheim the following weekend.

Having given consideration to the submissions in respect of penalty, the Committee suspended Ms Tomlinson's horsewoman's licence from the completion of racing today, 4 June 2007 until completion of racing on 10 June 2007 (an effective 2 days).
