Decision:
Following the running of Race 2, the Seelite Windows & Doors 2yo Ruby, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr A. L. Clark, the driver of THE FIERY GINGA (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 2, the Seelite Windows & Doors 2yo Ruby, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr A. L. Clark, the driver of THE FIERY GINGA (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.
--Mr Clark had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.
--Mr Escott gave evidence and used video coverage to show that Mr Clark had used his whip on about 20 occasions over the concluding stages of the race.
--Penalty:
In relation to penalty Mr Escott advised that Mr Clark had a previous conviction for a breach of this Rule on 9 May 2009 when he was fined $300-00. On that occasion it was a Group 2 race. This was also a Group 2 race, and as Mr Clark had admitted this breach Mr Escott recommended a fine of $400-00.
Taking all the above matters into account we were satisfied that a fine of $400-00 was appropriate in this case. Accordingly Mr Clark was fined the sum of $400-00.
