Facts:
Following the running of Race 2, Ashburton Security Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, by DARK MOMENT (D B Earnshaw), placed 12th by the judge, against THE TRUTH (M P Edmonds, placed 3rd by the judge, and CONTADOR (M Purdon), placed 5th by the judge, alleging that “racing into the first bend DARK MOMENT broke when racing in confined quarters on the inside of THE TRUTH and outside of CONTADOR”.
Rule 869 provides as follows:
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
At the outset of the hearing, Mr McIntyre declared that he had a family connection with a part-owner of DARK MOMENT. He sought and was granted leave to withdraw from the hearing.

Mr N M Ydgren, Stipendiary Steward, said that the Stewards were alleging that, shortly after the start, DARK MOMENT was checked into a gallop.
Mr S P Renault, Stipendiary Steward, showed video replays of the first 200 metres of the 1609 metres mobile start race. He pointed out the runners involved – DARK MOMENT had drawn 7 of 8 runners on the front row of the mobile, THE TRUTH had drawn the outside of the front row and CONTADOR had improved up on the inside of DARK MOMENT, having drawn 5 on the second row. He pointed out, racing into the first bend, BROOKSIDE FILLY (P C Nairn) break, forcing Mr Purdon driving CONTADOR to take evasive action outwards. DARK MOMENT was tightened and broke, losing its chance.
Mr Earnshaw said that there had been “general tightening from the inside out” as a result of breaking runners. He had called to Mr Edmonds, on his outside, for room. None of the pressure had been from his outside, Mr Earnshaw said.
Mr Purdon said that there had been a “concertina effect” after BROOKSIDE FILLY had broken in front of him and run out, squeezing his horse up. He had to shift out to avoid the galloping BROOKSIDE FILLY. Mr Earnshaw had received interference as a result.
Mr Edmonds said that he had moved neither in nor out. There had been contact with Mr Earnshaw on his inside. He had endeavoured to give Mr Earnshaw more room.
