Following the running of Race 3, Fulton Hogan Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Horseman, Mr M Purdon, alleging a breach of Rule 857 (4) in that Mr Purdon, as the driver of KOTARE MACH in the Race, “failed to wear a safety vest during this event”.

Following the running of Race 3, Fulton Hogan Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Horseman, Mr M Purdon, alleging a breach of Rule 857 (4) in that Mr Purdon, as the driver of KOTARE MACH in the Race, “failed to wear a safety vest during this event”.
--Mr Purdon had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.
--Rule 847 (1) provides as follows:
(1) No horseman shall check out or attempt to check out unless he wears safety gear which complies with the requirements of the Safety Gear Regulations made by the Executive”.
Mr Renault informed the Committee that Mr Purdon’s explanation was that he had been running late following giving an interview on “Trackside”. When questioned by the Stewards following the Race, Mr Purdon freely admitted that he was not wearing a vest.
Mr Renault recommended a fine of $400. Mr Purdon had endorsed the information form to the effect that a fine of $200 was appropriate.
--The Committee noted that the starting point for a breach of the Rule in the JCA Penalty Guide is a fine of $500. Having regard to that and to Mr Purdon’s admission of the breach, Mr Purdon was fined the sum of $400.
