Following the running of race 8 an information was laid by the Stipendiary Stewards under rule 869 (2) (a) alleging that Mr Howard, the driver of THE DRUNKEN DRUMMER, used his whip excessively through out the run home.

Following the running of race 8 an information was laid by the Stipendiary Stewards under rule 869 (2) (a) alleging that Mr Howard, the driver of THE DRUNKEN DRUMMER, used his whip excessively through out the run home.

At the outset of the hearing Mr Howard confirmed that he did not admit the breach and although on the information he said that he would not be attending the hearing he was, in fact, there.

Mr Ydgren on behalf of the Stipendiary Stewards said that they observed Mr Howard using his whip on THE DRUNKEN DRUMMER through out the run home and in his view the use of the whip was in breach of the rule and the guidelines.  The video evidence of the run home was then shown to the Committee and the Stipendiary Stewards asked the Committee to note that Mr Howard had used his whip in excess of 22 times over a distance of approximately 200 metres without any discernible break in his action.

Mr Howard was asked to give his view of the incident but he declined to do so.

The Committee after giving consideration to the evidence finds the charge proven. The Stipendiary Stewards in respect of penalty said that Mr Howard had an offence under the rule last season on 10 May 2008 at which time he was fined $200.00. The Stipendiary Stewards advised that they were seeking a monetary penalty only and that that penalty should reflect the previous breach in the last year.

Mr Howard was then asked to comment on penalty but he declined to do so.

The Committee, after giving consideration to the submissions made, is of the view that a monetary penalty is appropriate and after taking into account the previous breach of the rule in the last 12 months a fine of $300.00 was imposed.
