Facts:
Mr Ydgren, stipendiary steward, alleged that in race 1, the Ashburton Security Trot, DAVEY’S GIFT, placed 4th by the Judge, broke inside the final 50 metres and was lapped on by MOA BONES when it galloped across the line.

The margin between 4th and 5th was ¾ L.
Rule 870(5) provides;
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or
horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
Mr Ydgren read r 870(5) and demonstrated by reference to the video that DAVEY’S GIFT broke with just under 50 metres to race and continued in a gallop across the line. He froze the video as DAVEY’S GIFT was at the winning post. This demonstrated DAVEY’S GIFT was lapped on by MOA BONES.
The information indicated that Mr Ward did not contest the protest. Mr Ydgren confirmed for the committee that Mr Ward represented the connections of the horse and was in fact a co-owner.
Reasons for Decision:
We are satisfied after viewing the video and the print of the photo finish and, having regard to the official margin of ¾ L, that DAVEY’S GIFT was lapped on by MOA BONES when DAVEY’S GIFT galloped across the line. There is no suggestion nor any evidence that the horse was not in its correct gait due to interefence. The provisions of r 870(5) are mandatory. We relegate DAVEY’S GIFT to behind MOA BONES.
