Following the running of race number 2 an information was lodged by the Stipendiary Stewards pursuant to rule 869 (5) alleging that S J Thompson (Miss Chievous) half carted for approximately 400 metres from the 1800 metre mark.

--Following the running of race number 2 an information was lodged by the Stipendiary Stewards pursuant to rule 869 (5) alleging that S J Thompson (Miss Chievous) half carted for approximately 400 metres from the 1800 metre mark.

At the outset of the hearing Mr Thompson confirmed his written acknowledgement of his admittance of the breach.

The Stipendiary Stewards then showed the Committee the video evidence of the incident which clearly showed that Miss Chievous driven by Mr Thompson half carting for approximately 400 metres. The charge was formally proven.

The Stipendiary Stewards advised the Committee that Mr Thompson had not been charged under this rule in the last twelve months and that he was a reasonably experienced junior driver having had 576 career drives. The Stipendiary Stewards recommended a fine.

Mr Thompson, for his part, said that he would like the penalty kept at the minimum as he was employed only as a stable hand.

The Committee, after giving consideration to the incident, the mitigating factors (early guilty plea and good driving record) agree that a fine only is appropriate and, accordingly, a fine of $100.00 is imposed.
