Following the running of Race 5 an information was lodged by Chief Stipendiary Steward Mr N. R. Escott against Mr R. T. May alleging a breach of Rule 869(6)(b)(c) in that Mr May (Rocket Reign) forced Keytoourdreams (G. D. O?Reilly) to race wider on the track after approximately 350-400 metres.

DECISION AND REASONS:
--Following the running of Race 5 an information was lodged by Chief Stipendiary Steward Mr N. R. Escott against Mr R. T. May alleging a breach of Rule 869(6)(b)(c) in that Mr May (Rocket Reign) forced Keytoourdreams (G. D. O?Reilly) to race wider on the track after approximately 350-400 metres.
--Mr May confirmed that he did not admit the breach of the Rule although at the outset stated that he had not seen the video of the incident.
--Mr O?Reilly gave evidence that shortly after leaving the front straight Mr May had been eased down to the pegs by Christian Fire (R. D. Holmes). Mr O?Reilly was then able to take up the position one off the rails on the outside of Mr May but was immediately forced into the three wide line when Mr May came off the pegs. In response to a question from Mr Escott, Mr O?Reilly confirmed that at that stage he was on a forward movement. Mr May did not contest the evidence from Mr O?Reilly.
--Mr McIntyre then showed the video of the particular section of the race. Mr May contended that he was never actually on the pegs and therefore was entitled to continue racing one off the pegs and was not the cause of Mr O?Reilly racing in the three wide line. Mr Escott disputed this contention and stated that the film clearly showed Mr May on the pegs.
--The committee then adjourned to make its decision. When we reconvened we delivered the following oral decision.
--"The committee has heard evidence from drivers G. D. O?Reilly, R. T. May, Stipendiary Stewards and viewed the films. The committee finds that Mr May was lawfully eased down to the pegs by Christian Fire (R. D. Holmes). Mr O?Reilly's horse, Keytoourdreams took up that trailing position and shortly thereafter Mr May when not entitled to do so forced Keytoourdreams into the three wide line. At the time Keytoourdreams was on a forward movement. Therefore we find a breach of the stated rule occurred. We accordingly find the charge proven."
--PENALTY: Mr Escott informed the committee that Mr May has not been charged under this Rule in the past year. He also stated that the normal fine for a breach of this rule was in the vicinity of $200 - $250. However this race was worth $17,000 and Mr May had not admitted the charge. Mr Escott said that the Stipendiary Stewards recommended a fine in the vicinity of $450 - $500. Mr May felt the recommendation was too harsh given his clean record and that he had no opportunity to view the film prior to the hearing.
--The committee took the mitigating factors that Mr May raised into account when reaching its penalty. However it also took into account that the event was raced for a stake of $17,000 and that the chances of Keytoourdreams were adversely affected by this incident.
--After taking all these matters into consideration Mr May was fined the sum of $350.00
