DECISION & REASON
--Following the running of race number 7 an information was lodged by the Stipendiary Stewards pursuant to rule 869 (2) (a) alleging that Mr J Keast used his whip excessively in the run home while driving Free As A Bird.
----At the outset of the hearing Mr Keast, who was present, confirmed his written admittance of the breach and that he understood the relevant rule.

The Stipendiary Stewards demonstrated the incident with the use of the video camera which showed that Mr Keast hit his horse Free As A Bird without any noticeable change of action or delay approximately 20 times in the run home.
The breach is accordingly found proven.
----In respect of penalty the Stipendiary Stewards intimated that was Mr Keast’s first offence over the last 12 months and that they sought a monetary penalty.

After taking into consideration all matters raised at the hearing a monetary fine only is appropriate and accordingly the fine is $200.
