DECISION & REASON

Following the running of race number 4 an information was lodged by the Stipendiary Stewards instigating a protest against Kumar horse no. 15 placed 4th by the Judge alleging a breach of Rule 869 (8) (a) that Kumar at the start interfered with Last One Vance (1), Glengarry Sunrise (2) and Cadence (3) and as a result of the interference all three horses lost considerable grounds.

The relevant rule reads:

"The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

    1. may have gained an advantage by any conduct or interference prohibited by any preceding provisions of this Rule and/or
    2. --

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby."

Mr McIntyre said it was the Stipendiary Stewards contention that Kumar which had drawn 1 on the second line began fast along the inside of Last One Vance who had drawn 1 on the front line and then shied at something on the inside of the track and moved outwards suddenly interfering with Last One Vance and Glengarry Sunrise, which had both broken at the start, and with Cadence which had paced off the mark.

Mr Ydren with the assistance of the video evidence demonstrated the incident and it was evident that prior to the start Kumar, which was drawn on the inside of the second line, was back but inside of Last One Vance, drawn on 1 on the front line. Kumar made a good beginning but then veered sharply outwards about four horse widths on to Last One Vance which in turn moved on to Glengarry Sunrise, which in turn moved on to Cadence which broke and lost considerable ground.

Mr Butt, who acted for the connections of Kumar, said that his horse began well from the second line and then veered outward on to Last One Vance, which was already in a gallop, Glengarry Sunrise, which was in a gallop, and he thought that Cadence was also in a gallop. He did accept that the movement outwards was sharp and said that it was a 50/50 call.

The Committee, after giving consideration to all the evidence presented, is of the view that interference took place to all three horses and Kumar was responsible for the interference. The Committee, having given careful consideration to the matters raised at the hearing in relation to its discretion as to whether or not to relegate, is of the opinion that the interference was of a magnitude (Cadence taking no real part in the race) which requires that Kumar be relegated. Accordingly Kumar is relegated to 16th place immediately behind Cadence.
