Following the running of race number 1 an information was lodged by the Stipendiary Stewards instigating a charge against Mr M J Howard pursuant to rule 869 (2) (a) alleging that while driving The Drunken Drummer over the concluding stages of the race he used his whip excessively.

DECISION & REASON
--Following the running of race number 1 an information was lodged by the Stipendiary Stewards instigating a charge against Mr M J Howard pursuant to rule 869 (2) (a) alleging that while driving The Drunken Drummer over the concluding stages of the race he used his whip excessively.
----At the outset of the hearing Mr Howard confirmed that the breach was not admitted and that he understood the rule and regulations.
----Mr McIntyre said that the Stipendiary Stewards noted during the running of the race and over the concluding stages that Mr Howard appeared to use his whip excessively and after viewing the video evidence was of the view that he hit his horse, either the cart, shaft or horse itself, on 22 occasions in the run home which they considered was excessive.
----Mr Ndgren said that he observed the incident and it was his visual view that Mr Howard hit his horse The Drunken Drummer on more than 20 occasions without any noticeable change of action or delay.
----Mr Howard, for his part, simply said that because he did not hit the horse on every occasion he did not believe that the use of the whip was excessive.
----The Committee, after giving consideration to the evidence, the provisions of the relevant rule and regulations, are of the view that the allegation complained of is proven and in that respect prefers the evidence of the Stipendiary Stewards to that of the Defendant.
----With regard to penalty Mr McIntyre noted that Mr Howard had not appeared on such a charge over the previous 12 months and recommended either a fine or a suspension depending on Mr Howard’s circumstances.
----Mr Howard, for his part, indicated that he would prefer a suspension and after giving consideration to all matters Mr Howard’s Horseman’s Licence was suspended from the completion of racing, 15 November 2007, until the completion of racing on 1 December 2007 (an effective 2 days).
