Facts:

Following the running of Race 6 the “Ashburton ITM Winter Cup” an Information was filed by Stipendiary Steward Mr R Quirk alleging a breach of Rule 869 (2) (a) by Open Horseman Mr B Zampese. The Information stated that Mr Zampese used his whip in contravention of the use of whip guidelines.

Mr Zampese signed the information stating he admitted the breach and that he did not wish to be present at the hearing of the information.

Rule 869(2) provides 'No horseman shall during any race use his whip in an unnecessary, excessive, or improper manner'.

The Use of Whip Guidelines (effective 1 November 2017) provides (b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Quirk used the race video to identify Mr Zampese driving (1) SWEENEY TODD approaching the home straight. He pointed to Mr Zampese using his whip 16 times within the final 400 metres.

Mr Quirk stated that Mr Zampese agreed with the Stewards' count.

Submissions for Penalty:

Mr Quirk said this was a clear breach of the whip rule and using the sliding scale Penalty Guide for this number of strikes which is $300, the Stewards saw this as an appropriate penalty.

Reasons for Penalty:

The Committee, in determining penalty, found that there were no exceptional aggravating or mitigating factors to deviate from the JCA Penalty Guide.
