Facts:
Following the running of Race 5 the “Paddy Strange At Property Brokers Mobile Pace” an Information was filed by Stipendiary Steward Mr R Quirk alleging a breach of Rule 869 (5) by Open Horseman Mr R Alfeld. The Information stated that “Mr Alfeld through the back straight on the final occasion you did not trail the horse's seat in front of you for a considerable distance (half-carting)”
Mr Alfeld signed the information stating he admitted the breach and that he did not wish to be present at the hearing of the information.
Rule 869(5) provides: A Horseman shall trail with his horse's head behind the seat of the sulky being trailed.
Mr Quirk used the race video to identify Mr Alfeld driving (2) SANS LE SOU approaching the 1200 metres. At this point Mr Quirk showed Mr Alfeld to be half a cart out from the running line of the horse in front of him. He said as this continued for approximately 400 metres there were drivers behind that were unsure of their racing line and this may have impacted on their decisions to improve forward.
Submissions for Penalty:
Mr Quirk said that Mr Alfeld had a clear record for this rule and has admitted the breach at the first opportunity. He stated that Mr Alfeld would prefer a fine rather than a suspension and the Stewards saw this breach as mid-range.
Reasons for Penalty:
The Committee, in determining penalty, adopted the JCA Penalty Guide starting point for this rule which is a four- drive suspension or a $200 fine.
The aggravating factor is the length of time Mr Alfeld half carted for, being 400m.
Mitigating factors are his admission and good record.
Taking into account the Stewards' submissions and the above factors the Committee considered that a $200 fine is an appropriate penalty in this case.
