At the commencement of the hearing Mr K Hales, Panelist, declared a professional interest with the connections of SHANTALIA KNIGHT and took no further participation in the hearing.
Following the running of Race 9, the Canterbury Wool Brokers & Len Bell Memorial Pace an Information instigating a protest was filed by Stipendiary Steward Mr N Ydgren, alleging interference by SHANTAHLIA KNIGHT (11), driven by Mr K Cameron, who finished in 4th place, to CALL ME DANNY (7) placed 13th, driven by Mr J Anderson.

“SHANTALIA KNIGHT (K Cameron) shifted ground outwards in the run home checking CALL ME DANNY. By shifting out in this manner you have gained an advantage.”
Rule 869(8) provides as follows:
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
The connections of CALL ME DANNY were represented at this hearing by Open Horseman, Mr J Dunn and Mr J Anderson, Junior Horseman with Mr K Cameron representing the interests of SHANTALIA KNIGHT.
Submissions for Decision:
Mr Ydgren gave evidence and showed the relevant films of the incident which occurred shortly after the turn for home near the 200m. Mr Ydgren pointed out SHANTALIA KNIGHT racing midfield on the inside of CALL ME DANNY. He showed SHANTALIA KNIGHT shift outwards sharply at this point making solid contact and causing a considerable check to CALL ME DANNY who broke and lost all chance. Mr Ydgren submitted that as Mr Cameron has come out in such a manner to clear the pocket he was in, he has gained an advantage as a result of the interference. He said that had SHANTALIA KNIGHT eased out CALL ME DANNY in a slow and gradual manner SHANTALIA KNIGHT may not have finished in 4th place as the margin between 4th and 5th was a nose. Mr Ydgren also submitted that SHANTALIA KNIGHT had interfered with the chances and or progress of CALL ME DANNY.
Mr Anderson gave evidence that shortly after coming into the home straight SHANTALIA KNIGHT shifted out and appeared to overreact when making contact with CALL ME DANNY. Mr Anderson stated that CALL ME DANNY was “flat” around the bend but was going “ok” at the time of the interference.
Mr Dunn stated that CALL ME DANNY was not going to finish in the first 5 placings despite the interference and that SHANTALIA KNIGHT has also lost ground and momentum in the incident.
Mr Cameron said that SHANTALIA KNIGHT has had to check around and come out due to the horse in front shifting in when tiring and into his line. This manoeuvre he said had pushed CALL ME DANNY wider but that that horse was never going to fill a placing.
Reasons for Decision:
The Committee carefully considered the evidence given and the video coverage of the incident and was satisfied that SHANTALIA KNIGHT had shifted out on the home turn and made solid contact with CALL ME DANNY causing that horse to check, break and lose any chance. The Committee was also satisfied that SHANTALIA KNIGHT had gained an advantage due to the interference and that had SHANTALIA KNIGHT not interfered with CALL ME DANNY, that that horse may not have finished in 4th place by the margin of a nose. The Committee was also satisfied that the chances and progress of CALL ME DANNY were affected by the interference received from SHANTALIA KNIGHT.
Taking into consideration all factors, the Committee was satisfied that the protest should be upheld.
