The protest was upheld and ROCKNROLL KING was disqualified from the race.

Facts:
Following the running of race 8, the FARMLANDS ASHBURTON SOCIAL CLUB MOBILE PACE, an information instigating a protest was filed by Stipendiary Steward Mrs C Tibbs, against ROCKNROLL KING (C Thornley), placed 3rd by the judge, on the grounds that it “galloped in excess of 50 metres in the final 200 metres”.
Mr C Thornley, the driver of ROCKNROLL KING had endorsed on the information form and signed “I do not contest the protest”.
The official placings for the race were:

5th – 2 BARKLEY
Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.
Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).
Submissions for Decision:
Mrs Tibbs with the assistance of Mr Renault showed the race video replay of the final 200 metres of the race.
Mr Renault identified ROCKNROLL KING, driven by Mr Thornley, leading the field in the middle of the track passing the 200 metre mark. He pointed to the horse shortly after pace roughly and then gallop, free of interference, and continue on in a gallop for approximately 80 metres before regaining its gait and finishing in third place. Mr Renault then replayed the film and explained to the Committee that each track marker has 20 metres between them and showed ROCKNROLL KING galloping for just over 4 sections.
Mrs Tibbs submitted that the horse had galloped for a distance of approximately 80 metres inside the last 200 metres and sought disqualification of ROCKNROLL KING.
Mr Thornley agreed with the evidence and had no issue with the prospect of a disqualification.
Reasons for Decision:
The Committee was satisfied that ROCKNROLL KING had broken from its gait, free of interference, for approximately 80 metres within the last 200 metres, being placed 3RD across the line and therefore in breach of Rule 870 (3) and the Breaking Horses Regulation.
