At the outset of the hearing Mr Williamson, who was assisted by Mr P Williamson, confirmed that he admitted the breach. The charge is accordingly found proven.

The Stipendiary Stewards demonstrated the use of the whip by Mr Williamson with the assistance of the video evidence and said that Mr Williamson used the whip approximately 25 times in the run home and that that use was excessive.

In respect of penalty the Stipendiary Stewards advised the Committee that Mr Williamson was a young driver at the start of his career and had 63 race day drives to date. The Stipendiary Stewards recommended a monetary penalty only.

Mr Williamson accepted the recommendation of the Stipendiary Stewards in respect of monetary penalty and after giving Mr Williamson credit for his early guilty plea and frankness at the hearing a fine of $200.00 is imposed.
