Decision:
Following the running of race 5 an information was lodged under rule 869 (8) by the Stipendiary Stewards instigating a protest in respect of horse number 10 placed 3rd by the Judge alleging that with approximately 200 metres to run Almost a Christian ran on to Highbeam Rusty and as a consequent Highbeam Rusty lost ground.

At the outset of the hearing, Mr Purdon, the trainer/driver of Almost a Christian, confirmed that the protest was contested and that he understood the charge and the procedure.

Mr Ydgren, Stipendiary Steward, demonstrated the incident with the use of the video evidence and he asked the Committee to note Almost a Christian moving out to the two out position and in the process of the manoeuvre Highbeam Rusty was inconvenienced.

Mr C Thornley, the driver of Highbeam Rusty, said that he had been racing on the outside of Almost A Christian who had the wood on him and was manoeuvring him out. He said that his horse was hanging in and he was trying to move out and that the horse wore a Murphy blind on the near side. He said that he believed the movement outwards by Mr Purdon was in accordance with the rules and it was the racing manners of his horse that resulted in the slight contact between the two horses.

In response to a question from Mr McIntyre Mr Thornley again confirmed that Mr Purdon had the wood on him and that there was room for the manoeuvre that Mr Purdon executed.

Mr Purdon for his part said that he was looking for a run. He moved out into the gap and agreed that he had had the advantage of Highbeam Rusty which was hanging and due to Highbeam Rusty’s action that horse was inconvenienced.
----
The Committee after giving consideration to the evidence from the Stipendiary Stewards, the video evidence, the evidence of Mr Thornley and the evidence of Mr Purdon is not satisfied that interference was caused by Almost a Christian and accordingly the protest is dismissed. In arriving at the decision the Committee took into account the following:

· Mr Thornley’s evidence that Mr Purdon had the wood on him and that his horse had caused the contact between the two horses
--· Mr Purdon’s evidence as to the availability of the gap to execute the manoeuvre, and
--· The video evidence which supported the view of Mr Thornley and Mr Purdon
----
The placings as given by the Judge are confirmed.
