Following the running of Race 2, Tinwald Acres Yearling Sales Prep. Mobile Pace, Information No. 68021 was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr D J Dunn, alleging a breach of Rule 857 (5) (g) in that Mr Dunn, as the driver of ITSALLAGAME, “failed to come up and maintain his position behind the mobile”.

Following the running of Race 2, Tinwald Acres Yearling Sales Prep. Mobile Pace, Information No. 68021 was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr D J Dunn, alleging a breach of Rule 857 (5) (g) in that Mr Dunn, as the driver of ITSALLAGAME, “failed to come up and maintain his position behind the mobile”.
Mr Dunn was present at the hearing of the information and indicated that he admitted the breach. The breach was found proved accordingly.
--Rule 857 provides as follows:
(7) No horseman shall:-
(g) fail to come up into and/or maintain his position.
Mrs Williams showed video replays of the start of the 2400 metres mobile start event. Mrs Williams stated that Mr Dunn had drawn the outside barrier and was expected to lead the front line horses up the gate and be first on to the gate and maintain his position. Mrs Williams alleged that Mr Dunn had virtually been in the second row behind the gate. It did not appear that the horse was pacing roughly or that Mr Dunn was having any difficulty. Mrs Williams recommended a fine of $200-250.
--Mr Dunn submitted that the horse was having only its second start, having galloped at its first start. It was in the horse’s best interests that he endeavoured to keep it pacing. He had done so and the horse had finished in 2nd placing and had every chance. He acknowledged that he had got back too far before the start but said that the horse did not “feel safe”. Mrs Williams agreed that Mr Dunn had not previously breached the Rule. He had not even received a warning, Mr Dunn said. Mr Dunn also pointed out that he had not interfered with any other runner in the Race.
--The Committee, in determining penalty, looked at previous penalties for breaches of the Rule. Those penalties appeared to range from $100 to $250. The Committee took the figure of $200 as a starting point. Having regard to Mr Dunn’s admission of the breach and his excellent record under the Rule, particularly having regard to the number of drives that Mr Dunn has, the Committee decided that a fine of $150 was appropriate in all the circumstances.
--Mr Dunn was fined the sum of $150.
