"HERE'S SHIFTY" was scratched from the race, and all bets were directed to be refunded.
Facts:
Following the running of Race 6 at the Ashburton Trotting Club's meeting on Thursday 10th November 2011, Stipendiary Steward SW Wallis filed an information requesting a ruling in relation to an incident at the start.
Whilst the field was waiting for the barrier tapes to be released, "HERE'S SHIFTY" became somewhat restless. In the process, the horse dropped its head, lifted one of its front legs and as a result lifted its offside front leg out of its hopple. At that point, the barrier tapes were released before the horse's driver, Mr L McCormick could alert the starter to that fact. A starter's assistant who was standing close to the horse did not realise what had happened until it was too late. The assistant heard Mr McCormick call out but did not know why.
"HERE'S SHIFTY" paced away somewhat ungainly, but as the race progressed, it broke uncontrollably from its gait and as a consequence took no effective part in the race.

Mr Wallis submitted that it was appropriate for "HERE'S SHIFTY" to be scratched as it did not get a fair start.
Mr McCormick, after viewing the incident of the incident agreed with that submission.
Reasons for Decision:
As a result of "HERE'S SHIFTY" coming out of its off-side hopple it began somewhat ungainly, and at a later stage in the race broke from its gait. Had the starter been alerted to the situation then there is no doubt that the barrier tapes would not have been released until the horse was re-harnessed. It was in terms of the rule, it was denied a fair start, and such occurrence materially prejudiced the chances of the horse in the race.
