Facts:
As the field raced for the finishing post in Race 10 at the Ashburton Trotting Club's meeting, on Thursday 10th November 2011, "STRATHCULLEN", driven by G O'Reilly was a clear leader. However, at the 50 metre peg it began to pace roughly, and then broke from its gait.
Commendably, Mr O'Reily did everything required of him by taking a firm restraint on "STRATHCULLEN" and it lost ground rapidly as a result.
However, as the horses crossed the finishing line, "TARPORT SPIRIT" was lapped on to its hindquarters.
"STRATHCULLEN" crossed the line in second position with "TARPORT SPIRIT" in 3rd place.
Neither Mr O'Reilly or Mr Dunn were present at the hearing, each having advised the Stipendiary Stewards that the protest was not disputed, and that they did not wish to be present at the hearing.
Submissions for Decision:
Mr Wallis submited that "STRATHCULLEN" should be relegated behind "TARPORT SPIRIT".
Reasons for Decision:
After considering the evidence, we are satisfied that the protest should be upheld, as all components of the rule and the Breaking Horse Regulations were proved to our satisfaction.
