Following the running of Race number 5 the Stipendiary Stewards lodged an information instigating a protest in respect of horse number 12 [Anvils Just Fine] placed second by the judge on the grounds of interference to horse number 8 [Rock on Lavros] T Chmiel

DECISION & REASON
--Following the running of Race number 5 the Stipendiary Stewards lodged an information instigating a protest in respect of horse number 12 [Anvils Just Fine] placed second by the judge on the grounds of interference to horse number 8 [Rock on Lavros] T Chmiel rounding the final bend.
--At the commencement of the hearing Mrs Williams briefly summarised the Stipendiary Stewards position and stated that the Stipendiary Stewards has instigated a protest but had not held a preliminary hearing.
--Mr Chmiel [Rock on Lavros] said that his horse was moving forward and Anvils Just Fine was on its inside. When his horse was approximately level with Anvils Just Fine that horse came out sharply causing his horse to break stride and lose its chance in the race.
--The incident was demonstrated with the use of the various video recordings of the Race, which confirmed that Rock on Lavros had been moving forward and that Anvils Just Fine had moved out from a position inside.
--Mr G Smith [driver of Anvils Just Fine] had with him Mr A M Butt as Mr Smith is a junior horseman. Mr Smith said that said it was his opinion that incident was caused by Mr Chmiel's horse in as much as he already had his horse out from a trailing position when Mr Chmiel moved past him and attempted to push him back in.
--Mr B Williams the Stipendiary Steward situated at the top of the straight entrance said that he had a clear view of the incident and in his opinion the horse Anvils Just Fine had moved from a trailing position prior to Rock on Lavros breasting up alongside Anvils Just Fine. He said Rock on Lavros then headed Anvils Just Fine slightly and attempted to move that horse back in, Rock on Lavros then broke and lost all chance. Mr Williams demonstrated the incident with the assistance again of the video evidence and from that it was clear that just prior to the incident Anvils Just Fine had moved from a trailing position there had been an inward movement from Anvils Just Fine and as a result that horse left its gait and lost all chance in the race.
--The committee after given consideration to the evidence is satisfied that the incident was not caused by Anvils Just Fine moving outwards but by the inward movement of Rock on Lavros. Accordingly the protest is dismissed.
--The placing remain as given by the judge.
