Following the running of Race 3, the Sim’s Bakery Handicap Trot, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mr P. M. Williamson, licensed trainer of “Tullylish” (3) and “Geena’s Star” (4), alleging a breach of Rule 849(2). It was alleged that the defendant presented these two horses with their respective numbers transposed.

Following the running of Race 3, the Sim’s Bakery Handicap Trot, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mr P. M. Williamson, licensed trainer of “Tullylish” (3) and “Geena’s Star” (4), alleging a breach of Rule 849(2). It was alleged that the defendant presented these two horses with their respective numbers transposed.
--Mr Williamson had indicated on the information that this breach was admitted and that he did not wish to attend the hearing.
--Mr McIntyre gave evidence that this mistake had been noticed before the horses had gone on to the track, and the problem was rectified.
--Mr McIntyre advised that Mr Williamson had no previous convictions for a breach of this Rule, and as the breach had been admitted a fine of $150-00 was recommended.
After considering the matter of penalty we were satisfied that $150-00 was an appropriate fine in these circumstances, and accordingly Mr Williamson was fined the sum of $150-00.
